Aggravated manslaughter is a first-degree felony in Florida. It is defined as the unlawful killing of a human being by culpable negligence. Culpable negligence is a gross deviation from the standard of care that a reasonable person would have exercised under the same circumstances.
Aggravated manslaughter is a more serious crime than manslaughter, which is a second-degree felony. The difference between the two crimes is that aggravated manslaughter requires proof of culpable negligence, while manslaughter does not.
